TERMS AND CONDITIONS
1. BIDDER
REGISTRATION: All prospective buyers must register to bid. A
cashier's check or certified check, made payable to the
purchaser, will be required at registration. The successful
high bidder will be required to endorse said check as a
non-refundable deposit to the broker.
2. DOCUMENTS AVAILABLE: A bidder's information packet for
this property will be available on the day of the auction
and will include the legal description with a specimen of
the real estate purchase and sale agreement.
3. PROPERTY INSPECTION: Preview of the property is
essential. Property is being sold in "As Is, Where Is"
condition with no expressed or implied warranties. Property
will be sold subject to all easements, restrictions, zoning
and other matters of record.
4. RESERVE BID: Seller reserves the right to accept or
reject all bids.
5. AUCTION AND BID FORMAT: Auctioneer and/or Broker reserves
the right to bid on behalf of any buyer. The auctioneer
reserves the right to conduct the auction and to accept bids
in any increments he feels are in the best interest of the
Seller and reserves the right to waive any previously
printed or announced requirements.
All auction day announcements supersede any printed material
or any other auction statements previously made. The
Auctioneer may elect to cancel the auction at anytime
without penalty. The Auctioneer and/or Broker shall be held
harmless by the buyer and/or seller should the property fail
to go to a successful settlement for any reason.
All bidding is open and public. To bid during the auction, a
registered bidder need only raise a hand, shout out a bid,
or instruct an auctioneer's bid assistant to call out a bid
on your behalf.
6. REQUIREMENTS OF THE SUCCESSFUL BIDDER: There will be a
buyer's premium. The last bid (plus the buyer's premium, if
applicable) will establish the final sale price, if accepted
by the Seller. Immediately upon conclusion of the bidding,
the successful high bidder will be required to sign the real
estate purchase agreement, and will deposit a certified or
cashier's check in the amount of with the Broker.
7. FINANCING: This property is being sold for cash not
subject to any financing. Should you require financing, be
sure to have your financing in place prior to bidding.
8. TAXES: Taxes will be prorated to the day of closing.
9. CLOSING: The sale will close within Thirty (30) days of
auction subject to no contingencies, with the balance of the
purchase price due at closing.
10. TITLE: At closing the Seller shall provide a warranty
deed without liens, subject to all easements, restrictions,
zoning and other matters of record.
11. OCCUPANCY: Successful buyer shall have occupancy at
closing.
12. AGENCY DISCLOSURE: Broker, Real Estate Salespersons, and
Auctioneers are agents of the Seller in the sale of this
property.
13. DISCLOSURE: All information in this package was derived
from sources believed correct, but is not guaranteed. All
property dimensions are only approximations. Buyer shall
rely entirely on his own information, judgment, and
inspection of property and records. Any other terms and
conditions will be announced on the day of the auction and
will take precedence over printed matter.
14. FAIR HOUSING: As required by Federal and State laws;
Auctioneer, Broker, and/or Seller will not discriminate
because of race, religion, color, national origin, sex,
marital status, age, height, weight, physical disability,
mental disability, or familial status.
15. BROKER'S NOTICE: Please call for details. Not all
auctions have co-broker participation. A Broker must
register a buyer 72 hours prior to the auction if that
specific auction offers co-broker participation.
16. RISK TO PERSON AND PROPERTY: Any person attending the
inspection or auction sale assumes all risks of damage or
loss to person or property and specifically releases the
Auctioneer and/or Broker and his principal (s) from all
liabilities.
17. BIDDER(S) ACKNOWLEDGMENTS: By signing below you, as the
successful bidder, agree to the terms and conditions stated
herein. This document is part of the non-contingent Purchase
Contract of sale for property/s being offered at Auction on
this date.
In the
event of any conflict between this document and the purchase
agreement, the purchase agreement will prevail.
